Terms of Service

By accessing or using Keiro ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

These Terms constitute a legally binding agreement between you and KeiroLabs regarding your use of the Service.

Keiro is a triathlon race simulation and pacing optimization platform. The Service allows users to:

• Create athlete profiles with physical and performance metrics • Configure gear setups for race simulation • Generate race plans with predicted times and pacing strategies • Analyze course-specific conditions including weather and elevation

The Service is provided "as is" and is intended for informational and training planning purposes only.

To use the Service, you must:

• Be at least 18 years of age • Have the legal capacity to enter into a binding agreement • Not be prohibited from using the Service under applicable laws

By using the Service, you represent and warrant that you meet these eligibility requirements.

To access certain features of the Service, you must create an account. When you create an account, you agree to:

• Provide accurate, current, and complete information • Maintain and promptly update your account information • Keep your password secure and confidential • Accept responsibility for all activities under your account • Notify us immediately of any unauthorized access

We reserve the right to suspend or terminate accounts that violate these Terms.

Keiro offers subscription-based access to premium features. By subscribing, you agree to:

• Pay all applicable fees in EUR (€) unless otherwise specified • Authorize recurring charges to your payment method • Accept that subscriptions automatically renew unless cancelled

Payments are processed securely through Stripe. Refunds are handled in accordance with our refund policy and applicable consumer protection laws.

We may offer free trials or promotional pricing from time to time. Trial terms:

• Free trials are limited to one per user • You may be required to provide payment information • Unless cancelled before trial ends, your subscription will begin automatically • Promotional pricing may have specific terms

We reserve the right to modify or discontinue trials and promotions at any time.

You agree not to:

• Use the Service for any unlawful purpose • Share your account credentials with others • Attempt to gain unauthorized access to any part of the Service • Interfere with or disrupt the Service infrastructure • Use automated systems to access the Service without permission • Reverse engineer or attempt to extract source code • Use the Service to compete with Keiro • Resell or redistribute the Service without authorization

Violation of these terms may result in immediate account termination.

The Service, including its original content, features, and functionality, is owned by KeiroLabs and protected by international copyright, trademark, and other intellectual property laws.

You retain ownership of any data you input into the Service, including athlete profiles, gear configurations, and race plans. By using the Service, you grant KeiroLabs a limited license to use this data solely to provide and improve the Service.

You are responsible for the data you input into the Service. You represent that:

• You have the right to provide such data • The data is accurate to the best of your knowledge • The data does not violate any third-party rights

We handle your data in accordance with our Privacy Policy. You may export or delete your data at any time through your account settings.

The Service integrates with third-party services including:

• Supabase (database and authentication) • Visual Crossing (weather data) • Stripe (payment processing) • Mapbox (course visualization)

Your use of these services is subject to their respective terms and privacy policies. KeiroLabs is not responsible for third-party service availability or terms.

IMPORTANT: The Service provides race simulations and pacing recommendations for informational purposes only. Keiro is NOT:

• Medical advice or a substitute for professional medical consultation • Coaching services or professional athletic training • A guarantee of race performance or results

Race predictions are estimates based on the data you provide and environmental conditions. Actual results may vary significantly. Always consult with qualified professionals before making training or racing decisions.

You use the Service and act on its recommendations entirely at your own risk.

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• KeiroLabs shall not be liable for any indirect, incidental, special, consequential, or punitive damages • Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim • We are not liable for any injury, illness, or damages arising from your athletic activities

Some jurisdictions do not allow limitation of liability for certain damages. In such cases, our liability is limited to the maximum extent permitted by law.

You agree to indemnify and hold harmless KeiroLabs, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the Service • Your violation of these Terms • Your violation of any third-party rights • Any data you submit to the Service

You may terminate your account at any time through your account settings or by contacting us.

We may terminate or suspend your account immediately, without prior notice, for:

• Violation of these Terms • Fraudulent or illegal activity • Non-payment of fees • Extended periods of inactivity

Upon termination, your right to use the Service ceases immediately. We may retain certain data as required by law or for legitimate business purposes.

These Terms are governed by and construed in accordance with the laws of Sweden, without regard to conflict of law principles.

For users in the European Union, nothing in these Terms affects your statutory rights as a consumer under applicable EU law.

Any disputes arising from these Terms or the Service shall be resolved as follows:

1. Informal Resolution: We encourage you to contact us first at [email protected] to resolve disputes informally.

2. Mediation: If informal resolution fails, disputes may be submitted to mediation.

3. Legal Proceedings: Any legal action shall be brought in the courts of Stockholm, Sweden.

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• Posting the updated Terms on the Service • Updating the "Last updated" date • Sending an email notification for significant changes

Continued use of the Service after changes constitutes acceptance of the modified Terms. If you do not agree to the changes, you must stop using the Service.

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary. The remaining provisions shall continue in full force and effect.
